Barnstable Zoning Panel Drops Site Plan Review From Home Occupation Draft

Barnstable's zoning committee advances a two-tier home occupation permit framework, dropping a proposed site plan review step. The Town Council Zoning and Regulatory Committee, chaired by Councilor Steve Robichaud, met August 13 in a two-hour working session with Building Commissioner Brian Florence to continue revisions to the town's home occupation ordinance, which has been in place since the 1980s. Florence argued against using site plan review as an intermediate approval step, telling the panel that process "is about the dirt" and is not designed to evaluate land use questions.
The committee agreed that by-right uses must store all equipment and materials inside an enclosed structure or on a permitted commercial vehicle, while any use relying on outdoor screening would require a Zoning Board of Appeals special permit. Florence also presented a proposed home occupation license structure that would include vehicle plate numbers, contact information, and notation of any ZBA relief granted, replacing the current one-time registration system; he estimated Barnstable has roughly 8,000 to 10,000 businesses and recommended a two-year renewal cycle over the draft's proposed three-year interval. The next session is scheduled for August 27 at 5:30 p.m.
