Barnstable Conservation Commission Issues Four Enforcement Orders, Approves Three Projects

BARNSTABLE — The Barnstable Conservation Commission voted unanimously on all items at its June 16 meeting, issuing four enforcement orders and approving three projects. Agent Rob Brewer presented enforcement actions against Burton L. Roof Jr. of 365 Polish Hill Lane, Marstons Mills, for an unpermitted patio in the buffer to Middle Pond, and against 96 Airport Road LLC, where contractor Amerigas installed a propane tank and trenched within the 50-foot buffer of Fresh Hole Pond, drawing a $200 non-criminal citation; the commission amended that order to allow the owner to complete and backfill the installation by June 30 rather than excavate twice.

Agent Brady Hill's enforcement order for WS Arola LLC at 165 Stubbs Road, Osterville, covered continuous tree topping on a coastal bank above the Seapuit River, unpermitted hardscape, and removal of two trees without permits; the commission amended the order to reduce a replacement tree caliper requirement from 3 to 2 inches and to allow property owner Alden Edmonds to file an after-the-fact Notice of Intent for a roughly 12-by-12-foot deck that has existed on the bank for approximately 100 years. A fourth enforcement order, for an unpermitted dock on Long Pond at 7 Scottsdale Road, Sanderville, was approved after property owner Derek Pine confirmed the dock was already being removed.
